Trademark, Service Mark Registration Instructions

An application is made by filing the following:

• Trademark or Service Mark Initial Registration (21 VAC 5-120-50 B)
  1. Form TM 1 (Notarized)
  2. $30 (payable to Treasurer of Virginia) per mark, per classification
  3. 1 specimen of the mark (demonstrating use in Virginia)
  4. 1 exhibit which shows exactly how the mark appears.
  5. Classification of the mark as defined in 21 VAC 5-120-100.
  6. Any other information the Commission may require.
• Trademark or Service Mark Renewal (21 VAC 5-120-70)
  1. Form TM 2 (Notarized)
  2. $30 (payable to Treasurer of Virginia per mark, per classification
  3. 1 specimen of the mark (demonstrating use in Virginia)
• Trademark or Service Mark Name Change (21 VAC 5-120-80 B)
  1. Form TM 3 (Notarized)
  2. $30 (payable to Treasurer of Virginia)
• Trademark or Service Mark Assignment (21 VAC 5-120-80 A)
  1. Form TM 4
  2. Assignments shall be by instrument in writing duly executed and include the good will of the mark.
  3. $30 (payable to the Treasurer of Virginia)
